Terms of Service — The Baseball Mind

Welcome to The Baseball Mind. These Terms of Service ("Terms") govern your access to and use of The Baseball Mind mobile and web application (the "Service") provided by The Baseball Mind LLC ("we," "us," or "our").
By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. Where the Service requires you to affirmatively acknowledge these Terms, such as by checking a required box, that acknowledgment is a condition of proceeding, as described in Section 2.4.

1. Eligibility
You may use the Service if you are at least 13 years old, or if you are under 13 with verifiable parental consent as described in our Privacy Policy.
If you are using the Service on behalf of a team, league, or organization, you represent that you have the authority to bind that entity to these Terms.
2. Account Registration
2.1 Guest Mode
You may use the Service without creating an account (Guest Mode). Guest progress is stored locally on your device and is not backed up to the cloud.
2.2 Account Creation
To access cloud sync, cross-device features, subscription content, and team features, you may create an account using email/password, Google Sign-In, or Apple Sign-In.
2.3 Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at tanner@thebaseballmind.com if you suspect unauthorized access.
You must provide accurate information when creating your account. You may not create an account using someone else's identity or a false identity.
2.4 Acknowledgment of These Terms
Before you may proceed past the position-selection step of onboarding, or enter Guest Mode, you must affirmatively acknowledge these Terms and our Privacy Policy, and separately confirm that you are 13 years of age or older or that verifiable parental consent has been obtained as described in our Privacy Policy, each by checking a required box. This acknowledgment is versioned. If we materially revise these Terms or our Privacy Policy, you will be prompted to review and re-acknowledge the updated documents before continuing to use the Service.
3. Subscription Plans and Billing
3.1 Subscription Tiers
The Service offers the following subscription tiers:
- Free Tier: Access to Daily Questions (10 questions per calendar day) and Guest Mode features
- Premium Subscription: Full access to all positions, quiz modes, Coach Rules, General Knowledge, and advanced features
Current pricing is displayed within the app.
3.2 Billing
Premium Subscriptions are billed through:
- Apple App Store (for iOS users) via your Apple ID
- Google Play Store (for Android users) via your Google Play account
Subscription fees are charged to your account at the point of purchase and at the start of each renewal period.
3.3 Automatic Renewal
Subscriptions renew automatically at the end of each billing period unless canceled at least 24 hours before the current period ends. You will be charged at the applicable rate at the time of renewal.
3.4 Managing Subscriptions
You may manage or cancel your subscription at any time through:
- iOS: Settings → Apple ID → Subscriptions
- Android: Google Play Store → Menu → Subscriptions
4. Free Trial and Cancellation
If we offer a free trial period, you will be charged the subscription fee at the end of the trial unless you cancel before the trial ends. Cancellation instructions are provided in Section 3.4.
Canceling a subscription stops future charges but does not entitle you to a refund for the current billing period. You retain access to Premium features until the end of the current billing period.
5. Refund Policy
All subscription purchases are final and non-refundable, except as required by applicable law. For refund requests, contact the platform where the purchase was made:
- Apple purchases: https://reportaproblem.apple.com
- Google Play purchases: https://play.google.com/store/account/subscriptions
We do not process refunds directly.

6. Acceptable Use
You agree NOT to:
- Use the Service for any unlawful purpose
- Violate any third-party rights (intellectual property, privacy, publicity)
- Attempt to gain unauthorized access to the Service, other user accounts, or our servers
- Reverse engineer, decompile, or disassemble the Service
- Scrape, harvest, or copy content from the Service using automated means
- Interfere with or disrupt the Service or its servers
- Use the Service to transmit malware, viruses, or harmful code
- Impersonate any person or misrepresent your affiliation
- Harass, abuse, or harm other users or coaches
- Use the Service to compete with us or create a substantially similar service
- Circumvent subscription tiers or fraudulent purchases
- Share your account credentials with others
Violation may result in immediate account termination and legal action.
7. User Content and Feedback
7.1 User Content
You retain ownership of any content you submit through the Service (feedback, support messages, custom notes). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, modify, and display that content for the purpose of operating and improving the Service.
7.2 Feedback
If you provide feedback, suggestions, or ideas about the Service, we may use them without restriction or compensation to you.
8. Intellectual Property
8.1 Our Content
All content in the Service — including questions, answers, explanations, visual diagrams, movement notations, categorizations, illustrations, logos, and app design — is owned by The Baseball Mind LLC or licensed to us. It is protected by copyright, trademark, and other intellectual property laws.
The "The Baseball Mind" name and logo are trademarks of The Baseball Mind LLC.
8.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial baseball education. You may not:
- Copy, modify, or distribute the Service or its content
- Use our content for commercial purposes without written permission
- Remove copyright or trademark notices
- Redistribute or resell subscriptions
8.3 Educational Fair Use
Coaches and instructors may use the Service in classroom, team practice, and educational settings under a Premium subscription. Contact us for team or league pricing.
9. Third-Party Services
The Service integrates with third-party services (Firebase, RevenueCat, Apple App Store, Google Play Store). Your use of those services is governed by their own terms and policies, which we do not control.
10. Disclaimers
10.1 "As Is" Basis
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
10.2 Educational Content Disclaimer
Content is designed for educational purposes. Rule citations and interpretations are based on published rulebooks (OBR, NFHS, Little League, etc.) at time of authoring. Rulebooks change; users are responsible for verifying current rules with their applicable governing body. We are not a certified umpire training organization.
10.3 No Coaching Certification
Completing quizzes in the Service does not constitute coaching certification, umpire certification, or any other formal credential.
10.4 Youth Sports Disclaimer
We are not affiliated with, endorsed by, or sponsored by Major League Baseball, the NCAA, NFHS, Little League Baseball, Babe Ruth League, USSSA, or any other governing body unless expressly stated.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE BASEBALL MIND LLC SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Lost profits, lost data, or lost business opportunities
- Damages arising from your use of or inability to use the Service
- Damages arising from third-party services or content
- Damages from unauthorized access to your account
Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.
Nothing in this Section 11 limits our liability for gross negligence, willful misconduct, or a violation of an applicable consumer protection statute, including Florida's Deceptive and Unfair Trade Practices Act, to the extent that liability cannot lawfully be limited.
Some jurisdictions do not allow limitation of liability. In those jurisdictions, our liability is limited to the greatest extent permitted by law.
12. Indemnification
You agree to indemnify and hold harmless The Baseball Mind LLC, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:
- Your violation of these Terms
- Your violation of any third-party rights
- Your use or misuse of the Service
- Content you submit through the Service
13. Termination
13.1 Termination by You
You may terminate your account at any time by using the "Delete Account" option in Settings (when available) or by contacting tanner@thebaseballmind.com.
13.2 Termination by Us
We may suspend or terminate your account without notice if you violate these Terms, engage in fraudulent activity, or if we discontinue the Service.
13.3 Effect of Termination
Upon termination:
- Your right to use the Service ceases immediately
- Subscription fees are not refunded (see Section 5)
- Your account data will be deleted per our Privacy Policy retention schedule
- Sections that by their nature survive termination (Intellectual Property, Disclaimers, Limitation of Liability, Dispute Resolution) remain in effect
14. Dispute Resolution and Governing Law
14.1 Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of laws principles.
14.2 Informal Resolution
Before filing any formal claim, you agree to attempt to resolve the dispute informally by contacting tanner@thebaseballmind.com. We will attempt to respond and resolve within 60 days.
14.3 Arbitration
If informal resolution fails, disputes shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration shall take place in Florida. Judgment on the award may be entered in any court of competent jurisdiction. If any part of this Section 14.3 is found unenforceable, the remainder of this arbitration agreement shall remain in full force and effect.
14.4 Class Action Waiver
You agree that any dispute will be resolved on an individual basis. You waive the right to participate in class actions, class arbitrations, or representative actions.
14.5 Exceptions
The following disputes are exempt from arbitration:
- Small claims court actions
- Intellectual property disputes
- Injunctive relief for violations of Sections 6 (Acceptable Use) or 8 (Intellectual Property)
15. Changes to Terms
We may update these Terms from time to time. Material changes will be announced within the app with 30 days' notice. Your continued use after changes constitutes acceptance of the updated Terms.
16. Weekly Leaderboard Prize; Official Rules
16.1 Eligibility and No Purchase Necessary
No purchase, payment, or Premium subscription is required to enter or win the weekly leaderboard prize. Free Tier accounts and Premium Subscription accounts compete for the prize on the same footing, based on XP earned through gameplay available to each tier.
16.2 How the Weekly Winner Is Determined
The weekly winner is the user with the highest cumulative XP earned during that calendar week. If two or more users are tied on total XP at the end of the week, the tie is broken in the following order until a single winner is identified: (a) highest answer accuracy percentage for the week; (b) most total questions answered for the week; (c) longest correct-answer streak for the week; (d) earliest timestamp at which the tied XP total was reached. Winner determination involves no random draw, lottery, or other element of chance.
16.3 Prize Value and Fulfillment
The weekly prize has a value of less than $50. To fulfill a physical prize, we will ask the winner, or for a winner under 13, the winner's parent or guardian, to provide a mailing address. See our Privacy Policy for how that information is collected, used, and protected.
